These Terms of Service ("Terms") govern your access to and use of FinTrakker, operated by Firmhound LLC ("Company," "we," or "us"). By accessing the service, creating an account, or using any feature of FinTrakker, you agree to these Terms.

If you are using FinTrakker on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

FinTrakker is a SaaS compliance monitoring platform that aggregates publicly available fintech licensing data from government sources including NMLS Consumer Access, state financial regulator portals, and FinCEN's MSB Registrant Search. The service provides renewal alerts, status tracking, and regulatory change notifications for money transmitter licenses and related fintech licenses across all 50 U.S. states.

The service is intended for compliance officers, regulatory consultants, and financial services entities that hold or seek fintech licenses.

3. Account Registration

To use FinTrakker you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Subscriptions and Payment

FinTrakker is offered on a subscription basis. Subscription fees are charged in advance, either monthly or annually, as selected at the time of purchase.

5. Cancellation and Refunds

You may cancel your subscription at any time from the Account Settings page. Cancellation takes effect at the end of the current billing period. We do not issue prorated refunds for unused time on monthly plans. All plans include a 30-day money-back guarantee. If you are not satisfied within the first 30 days of your initial purchase, contact [email protected] and we will issue a full refund. After 30 days, annual subscriptions are non-refundable but access continues until the end of the paid period.

FINTRAKKER IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE, COMPLETE, OR TIMELY.

License status information provided by FinTrakker is sourced from publicly available government databases and is for informational purposes only. It does not constitute legal advice. Subscribers are responsible for independently verifying license status with the issuing regulatory agencies before relying on such information for compliance purposes.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRMHOUND LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO REGULATORY PENALTIES, LOST LICENSES, OR COMPLIANCE FAILURES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

FinTrakker and its original content, features, and functionality are owned by Firmhound LLC and are protected by copyright and other intellectual property laws. The underlying government data we aggregate remains in the public domain.

You may not copy, modify, distribute, sell, or lease any part of the service without our written consent.

10. Termination

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or engage in conduct that we determine in our sole discretion to be harmful to other users or the platform. Upon termination, your right to use the service ceases immediately. We will provide reasonable notice except where termination is due to illegal activity or an urgent security threat.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, unless you are located in a jurisdiction that requires court proceedings.

12. Changes to Terms

We may update these Terms at any time. For material changes, we will provide at least 30 days' advance notice via email to your registered address. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
